What is a Statement of Use?

A Statement of Use is a formal declaration submitted by a trademark applicant, indicating that the applicant is actively utilizing their trademark on goods and/or services that are offered for sale in interstate commerce.

In cases where trademark applicants are not currently using their mark in commerce, they may opt to file an Intent to Use Application. If the application proceeds favorably, the applicant will typically receive a Notice of Allowance. Following the issuance of the Notice of Allowance, the applicant is generally required to demonstrate actual use of the mark within six months or may request up to five extensions, each lasting six months. The United States Patent and Trademark Office (USPTO) mandates the submission of a specimen to verify use in commerce when filing a Statement of Use.
